Legal System
The legal system is at times hard to traverse for the citizen in search of justice. Even though the American federal court system is largely based on the English common law, it is noteworthy that each individual state still subscribes to its own legal system. Thus, federal and state laws may sometimes butt heads and it is hard for citizens caught in the crossfire to receive the help that they need.
Republican lawmakers and jurists will do a great act of service to the American public by furthering statute law – such as has already benefited the citizens under the names of the Federal Rules of Civil Procedure, the Federal Rules of Evidence, and the Uniform Commercial Code – and thus taking the often capricious twists and turns of various state laws out of the equation.
The latter are little more than the remnants of what appears nowadays an almost labyrinthine mode of fixing loop holes by patchwork rather than statute. By furthering the notion of equity across the country, not one state will appear more attractive to lawbreakers than another. It is not at all surprising that much confusion reigns even in the circles of those who deal with the law on a daily basis as to what a law may mean or specifically forbid. Add to this the fact that in recent history those entrusted with interpreting the laws have indeed taken to making laws from the bench, it is high time for such further reforms of the legal systems!
